Participation waiver and release

DEEP is intense, on purpose. Before you take a seat, read this once. Checking the box on the registration form means you have read it and agree to it.

The short version

Plain words first. The full text below is what you are agreeing to.

  1. What this isA live, guided emotional processing session on Zoom, in a group, about ninety minutes. Not therapy, not medical care. Jade is not your doctor or therapist in this room.
  2. What it does to youIt turns the nervous system up on purpose, including a few minutes of fast, forceful breathing, then brings it down. Strong emotion, tears, shaking, heat, light-headedness are normal. You can stop at any time.
  3. Who skips the fast partPregnant, a heart condition, high blood pressure, epilepsy, glaucoma, a history of psychosis or a psychiatric crisis: you do only the slow humming exhale when Jade says so, or you sit it out. Ask your own provider first if any of this is you.
  4. Where you do itSitting or lying down, never near water, never driving. Water nearby. Stop if you feel faint or unsafe. You are responsible for your own setting.
  5. The doorOn your Saturday the Zoom room is open from 10:45am to 11:10am Eastern. At 11:10 it locks, because the activation cannot be joined once it has begun. Arrive after that and you get the 48-hour replay instead.
  6. Your moneyEmail support@nextlevelhuman.com before 11am Eastern on the Friday before your Saturday and your seat moves or is refunded in full. After that the seat is yours, and so is the replay, and there is no refund. If we cancel, you get a new seat or a full refund.
  7. Your linkYour seat and your Zoom link are yours alone. Do not share them. Anyone you let in has not accepted this waiver, and you are responsible for them.
  8. Recording and privacyThe room is recorded for the 48-hour replay. Camera off and mic muted are always allowed, and if you keep them off you do not appear. What other people share stays in the room. You do not record anything.

General provisions

This waiver applies to every participant ("you") in the DEEP Clearing, a live online group session of about ninety minutes held on Zoom every Saturday (the "Session"), and to the teaching recording sent before it and the replay made available after it, organized by Next Level Human LLC, 8 The Green, STE B, Dover, Delaware 19901 ("Next Level Human," "we," "us"). It is written and executed in English; the English version controls.

The Session is DEEP (Depth-Enhanced Emotional Processing): guided emotional processing done live in a group. It includes deliberate activation of the nervous system using the body (including a few minutes of fast, forceful breathing, posture and sound), slow exhaling and humming, sustained attention on something distressing you are carrying (a feeling, a pattern, a person, a memory, or whatever arises), bilateral touch (self-hug, tapping), journaling, and a short period of integration. You take part from your own home or chosen location, alone or with others, over the internet.

Before you take part

Pre-screening

Part of the mission of Next Level Human is to offer a safe, supportive space for personal transformation. There are conditions we cannot safely support in this format. If you have a history of, or are currently experiencing, any of the following, do not take part in the fast-breathing portion, and do not take part in the Session at all without clearance from your treating provider: bipolar disorder, schizophrenia, psychosis, PTSD, an eating disorder, or any other psychiatric condition or emotional crisis requiring hospitalization; a seizure disorder; a heart condition; uncontrolled high blood pressure; aneurysm; recent surgery; glaucoma or retinal detachment; or pregnancy. If any of these applies, you do only the slow humming exhale when Jade says so, or you sit the Session out.

You are fully responsible for your own physical, emotional and spiritual well-being before, during and after the Session. If you are in crisis, contact your local emergency number or crisis line; the Session is not a crisis service.

Age

You must be 18 years of age or older to take a seat. Do not proceed if you do not meet this minimum age.

Your setting

Because you take part at home, you agree to: sit or lie down for the whole activation; never take part near water, in a bath or pool, while driving, or while operating anything that could hurt you or someone else; keep water nearby; stop immediately if you feel faint, have chest pain, or feel unsafe; and, if you have any of the conditions above or any doubt, have another adult reachable during the Session. You are solely responsible for the safety of your location.

Participation waiver, release of liability and consent

I, the participant, in consideration of my participation in the Session, agree to be bound by this waiver for myself and my personal representatives, executors, heirs, family members, successors and assigns, and acknowledge, agree and represent the following.

  1. Voluntary participationI desire to voluntarily participate in the practices offered in the Session ("Participation"). I am aware that Participation is intense and may bring up strong and unexpected emotion, memories, grief, anger or fear, and unusual psychological, emotional and physical states of mind and body, including light-headedness, tingling, shaking, crying, heat, chills, and in rare cases fainting. I am voluntarily participating with knowledge of the potential for unusual experiences. My Participation is voluntary, and I may decline or stop any practice at any time, including by leaving the Session.
  2. Assumption of riskI understand there is a level of risk associated with Participation and that my body's and mind's response cannot be predicted with complete accuracy. I HEREBY ACKNOWLEDGE AND ASSUME THE RISKS OF PARTICIPATION, including the risk of physical or psychological injury, illness, pain, suffering, disability and death. I agree that I am responsible for any resulting personal injury and any damage to or loss of property, and that I am solely responsible for any medical costs arising from it. It is my responsibility to determine whether I am sufficiently fit and healthy to participate safely.
  3. My own careI agree to consult my own doctor and obtain medical clearance, if required due to a health condition, before Participation. If a consultation is not required, I declare that I am in adequate physical and psychological condition for Participation and am not aware of any condition or symptom that would prevent me from participating. I understand that Participation is not a substitute for medical or psychological treatment, that I should keep my own providers and my own care, and that I will not stop or change any medication or treatment because of anything in the Session. I certify that I have not been advised against Participation by a qualified medical professional.
  4. Not medical careI agree that Next Level Human, including its members, managers, officers, employees, contractors, facilitators, coaches, volunteers, agents, successors and assigns, and Jade Teta individually (collectively, "Representatives"), does not dispense emergency medical services or medical advice, and does not offer any practice in the Session as a diagnosis or treatment for any mental, physical or medical problem, either directly or indirectly. Jade Teta is a naturopathic doctor licensed in California and Washington. He is not acting as my doctor, therapist or counselor in the Session, wherever I am located, and no doctor and patient or therapist and client relationship is created.
  5. ReleaseI understand that Next Level Human takes no responsibility for health risks during my Participation. I assume the risk of physical or psychological injury, illness or death and agree that my Participation shall at all times be at my own risk. I, ON BEHALF OF MYSELF AND MY PERSONAL REPRESENTATIVES, EXECUTORS, HEIRS, FAMILY MEMBERS, SUCCESSORS AND ASSIGNS, HEREBY KNOWINGLY AND VOLUNTARILY COVENANT NOT TO SUE AND AGREE TO WAIVE, RELEASE AND DISCHARGE Next Level Human and all of its Representatives from any liability, loss, cost, damage, expense, claim or suit whatsoever for any injury, loss, illness, death, harm, cost, expense, claim, suit or damage related to my Participation, including any negligent acts or conduct by Next Level Human and its Representatives (collectively "Claims"). I further agree to indemnify and hold harmless Next Level Human and its Representatives from and against any and all third-party Claims associated with my Participation, including Claims by anyone present with me during the Session or anyone I admit through my link.
  6. What is not releasedThis waiver does not release Next Level Human or its Representatives from liability for gross negligence, willful or wanton conduct, or any liability that cannot be released under North Carolina law.
  7. Nobody is in the room with meI understand that I am not in the physical presence of Next Level Human or its Representatives during the Session, that they cannot see or assist me physically, and that if I need emergency help it is my responsibility, or that of anyone with me, to summon it at my own cost.
  8. No promised resultI understand that Next Level Human makes no representation, warranty or guarantee about any outcome or result from my Participation, and that nothing said in the Session, in the teaching recording, or in any marketing is a promise of a result.
  9. My seat and my link are mine aloneMy seat and my Zoom link are personal and non-transferable. I will not share, forward or sell the link, the teaching recording or the replay. Anyone I admit to the Session or to the recordings through my link has not accepted this waiver; I am responsible for them, and Next Level Human may remove them, and may cancel my seat without refund.
  10. If part of this failsThis waiver is intended to be as broad and inclusive as permitted by the laws of the State of North Carolina. If any portion is held invalid, the balance remains in full legal force and effect.

Confidentiality and recording

What other participants share or show in the Session is confidential. I will not repeat it, write about it, post it, or identify any other participant as having attended. I may of course speak about my own experience.

I will not record any part of the Session. That includes screen recording, audio, video, screenshots, live streaming, transcription, and any application or artificial intelligence tool that captures or reproduces what happens in it.

I understand that Next Level Human records the Session to produce the replay, which is made available to seat holders for 48 hours and then removed. If I keep my camera or microphone on, my image, voice and name as shown on Zoom may appear in that recording and be seen by other seat holders during the replay window. If I do not want to appear, I keep my camera off and my microphone muted, which is always permitted. Next Level Human does not use the Session recording for marketing without my separate written consent.

The teaching recording, the Session and the written material are the intellectual property of Next Level Human and are licensed to me for my personal use only.

Seats, changes and refunds

A seat is $55 for one Saturday. On my Saturday I may join the Zoom room between 10:45am and 11:10am Eastern. At 11:10am the room is locked, because the activation cannot be joined once it has begun; if I arrive after that, I receive the 48-hour replay instead of a seat in the room.

If I email support@nextlevelhuman.com before 11:00am Eastern on the Friday before my Saturday, my seat is moved to a later Saturday or refunded in full. After that the seat is mine, and so is the 48-hour replay, and no refund is owed, whether or not I attend. Next Level Human may cancel or reschedule a Session; if it does, my seat is moved or refunded in full.

Governing law

This waiver and my Participation, and all suits and proceedings relating to them, shall be governed by the laws of the State of North Carolina, without regard to the jurisdiction in which any action may be instituted. Venue for any legal or equitable action between Next Level Human and me shall be in the state or federal courts located in Buncombe County, North Carolina. I IRREVOCABLY CONSENT TO JURISDICTION AND VENUE IN NORTH CAROLINA FOR SUCH PURPOSES AND WAIVE ANY OBJECTION THAT NORTH CAROLINA IS NOT CONVENIENT. I AND NEXT LEVEL HUMAN FURTHER AGREE, TO THE EXTENT PERMITTED BY APPLICABLE LAW, TO WAIVE ANY RIGHT TO TRIAL BY JURY WITH RESPECT TO ANY CLAIM ARISING FROM MY PARTICIPATION. Affirmation

By checking the box on the registration form I confirm that I have read and understand the information, representations, covenants, releases and waivers stated above, that I am 18 or older, that the information I provide is true and correct, and that I voluntarily agree to be bound by this waiver. Any willful dishonesty may result in my seat being revoked with no refund, at the sole discretion of Next Level Human.
